    Adds to the proposed changes to Section 1 of SL 2020-94 regarding the deferral of permit fees for certain ABC permittees affected by Executive Order No. 141. Requires ABC permittees who delay payment pursuant to Section 1 to be current in the filing and payment of applicable taxes and submit the required recycling plan with renewal and registration applications, pursuant to specified state laws, before the expiration of the 90-day deferral period.

    Modifies the proposed changes to and further amends Section 1 of SL 2020-94 regarding the deferral of permit fees for certain ABC permittees affected by Executive Order No. 141. Now provides for ABC permittees who were subject to an order of closure pursuant to Section 8 of Executive Order No. 141 (was, prohibited from operating under Executive Order No. 141) to defer payment of renewal or registration fees until 90 days after the date all executive orders limiting the full operation of the permittee in response to the COVID-19 pandemic are rescinded or expire (was, after the date all executive orders responding to the COVID-19 pandemic and limiting the full operation of the permittee are rescinded or expire). Makes identical changes in phrasing to Section 4 of the act concerning ABC permittees' refund requests for fees paid. Additionally, mandates that any permit held by a permittee who receives a refund must remain active.

    Modifies Section 3 of the act regarding refund requests for ABC permit fees, to explicitly allow ABC permittees who held a permit for 2020-21 for a business that was prohibited from operating under Executive Order No. 141, paid renewal or registration fees, and surrendered the permit due to closure of the business, to request a refund of fees paid pursuant to the act's provisions. Bars requiring such permittees to repay the fees.

    House committee substitute amends the 1st edition as follows.

    Repeals Section 2 of SL 2020-94, which provides for ABC permittees who are prohibited from operating under Executive Order No. 141 and who have paid renewal or registration fees prior to June 30, 2020, to request a refund of fees paid and provides for fee repayment within 90 days of the Governor rescinding orders prohibiting permittee operations. Enacts new refund provisions, allowing for any ABC permittee to request a refund from the ABC Commission (Commission) if the permittee is prohibited from operating under Executive Order No. 141, or subject to any COVID-19 executive order limiting its full operation, and has paid renewal or registration fees for 2020-21. Requires written request, which may be electronic, and mandates granting requests regardless of whether the permittee is operating at limited capacity. Requires repayment of the fee within 90 days after the date all executive orders responding to the COVID-19 pandemic and limiting the full operation of the permittee are rescinded or expire.

    Regarding mandatory reinstatement of any ABC permits canceled or moved to inactive status due to the Commission's previous implementation of Section 1 of SL 2020-94, allows permittees to request refunds as provided above if the permittee has paid a permit fee for reinstatement or reactivation.

    Amends Section 1 of SL 2020-94, which defers payment of ABC permit renewal or registration fees by permittees prohibited from operating under Executive Order No. 141. Now defers payments until 90 days after the date all executive orders responding to the COVID-19 pandemic and limiting the full operation of the permittees are rescinded or expire (was, 90 days after the date the Governor signs an order rescinding the prohibition on those permittees' operation). Maintains the required written notice to the ABC Commission (Commission) of a permittee's intent to delay payment. Effective retroactively to June 30, 2020.

    Directs the Commission to reinstate or reactivate any ABC permits canceled or moved to inactive status due to the Commission's previous implementation of Section 1 of SL 2020-94, and bars requiring affected permittees to submit an application or pay any fees in doing so.
